Abstract

A brief has been prepared to present the case of the Amish in Oelwein County, Iowa before the United States Supreme Court. This case will deal with the supposed infringement of the school system and the educational laws of Iowa upon this relatively small non-conforming group. This court case has been preceded by a long series of conflicts at the local level and often in the local courts. This is not a simple case as there are legal, sociological, and ethical considerations involved which may present opposing conclusions. It is the thesis of this paper that there are legal grounds for a Supreme Court decision in favor of the Amish and that the associated conflict may be functional in the maintenance of a pluralistic society.
