Abstract

The purpose of this paper is to analyze and evaluate the use of restitution in the Kalamazoo County Criminal Justice System. By doing extensive research; utilizing the countless articles and books written on restitution; interviewing prosecutors, probation and corrections officials, state legislators, judges, and Western faculty members; and writing and receiving letters from established Restitution Programs in other states, this project has taken shape. The major focus of this paper will on the manner in which restitution is used in Kalamazoo County, the factors affecting its use, the impact on the criminal justice community resulting from that use, the attitude of those individuals directly involved with restitution and the problems facing the use of restitution is the criminal process. To help achieve the goal of this project the historical development of restitution will be examined; the concept and forms of restitution will be defined; the theories of punishment and the relationship to restitution will be discussed; and the use of restitution in other states will be described.
