Abstract
Few issues of constitutional law have prompted as much controversy as affirmative action. Affirmative action is one of the most divisive issues faced by society today. "The implementation of voluntary affirmative action programs and the imposition of judicially mandated race and sex-conscious measures and remedies have fueled the ongoing debate regarding the legal, moral, and economic questions arising from preferential treatment of certain segments of society." (Turner, 1990, p.xiv). The future of affirmative action, at the very least, can be reasonably predicted to be bleak.
